Here?s how to file:

  • Go to a counselor: Attend a credit counseling course. ?The course takes approximately 90 minutes and you learn about credit and budgeting,? says Gershburg.
  • Do the paperwork: ?Fill out petition and schedules, preferably with an attorney who understands exemptions (what you can keep when filing), all the income tests and rules, and will ask the right questions about transfers or payments to relatives. [He/she] also will understand which debts will be discharged,? says Weiner.
  • Be organized: ?File petitions, schedules, counseling certificates, and 60 days of pay stubs with court,? Weiner tells Madame Noire.
  • Follow up: ?After trustee assigned to case, mail all papers to trustee together with last tax return,? Weiner explains.
  • Take a 341 Meeting a.k.a. the?Meeting of the Creditors: About three weeks after you file for bankruptcy, you should meet with a trustee to go over the bankruptcy estate and other financial data, including the amount you?ve kept in your checking account, inheritances and other info, Gershburg explained to us.
  • Class in session: You will be required to go to another credit counseling class to get your discharge papers, which will be sent about 60 days after, Gershberg said. Keep your bankruptcy lawyer on hand.

If Braxton did transfer some of her money into her husband?s bank account, it?s something that could have been remedied by a bankruptcy trustee, Weiner points out. Federal bankruptcy law gives you two years to undo this action, and most states will give you six years.

?What this means is that if you transfer an asset to anyone for less than fair consideration at a time when you are in debt, the trustee will sue the transferee to avoid the transfer and bring the asset into the bankruptcy so he or she can sell it,? he says. ?Another thing that gets people in trouble is repayment of loans to relatives within one year of filing. A trustee can recover that money as a preferential payment.?

If in doubt, check with an attorney. ?Your relatives are no different, under bankruptcy laws, than Visa or American Express,? says Gershburg.???Giving your relatives assets prior to bankruptcy means that the other creditors can?t get their own debts paid. It can either be classified as preferential payments and/or a fraudulent transfer. While, to you, paying your mother maybe more important than paying Discover, doing so can risk your entire bankruptcy case.?

Microsoft CEO Steve Ballmer announced at the company's Build conference today?that more than 4 million Windows 8 upgrades had been sold since?the operating system's official launch on Friday. He also said "tens of millions of copies" had been shipped to partners.

Ballmer said?yesterday?that "preliminary demand" was higher for Windows 8 than it was for Windows 7, but offered no numbers to back up that claim at the time. The 4 million upgrades he announced today give some idea of the OS's success, but putting the numbers in context is actually quite complicated.

Aside from yesterday's remark, Windows 8 sales have not been compared to Windows 7's ? that's?not surprising considering the OS has only been available for a few days. Even when Windows 7 was moving?enough copies?to be considered the fastest-selling OS in history, Microsoft waited several weeks before announcing how sales compared to those of Windows Vista. So it will likely be some time before more solid numbers are announced.

Singling out upgrades complicates things further: People have been registering and qualifying for these reduced-price copies of Windows 8 since June, when new PCs began to ship with the guarantee of a $15 upgrade to the new OS upon launch.

Four million may or may not be considered a large number, depending on how it is interpreted in light of total PC sales. Numbers from Gartner put worldwide PC sales in the third quarter of 2012 (which roughly corresponds to the pre-order and upgrade period for Windows 8) at about 87.5 million. Theoretically, all those PCs qualify for the $15 upgrade. The 4 million represents?a 4.5 percent conversion rate for new PCs in the first ?week ? that sounds low, but these numbers are so early that few conclusions can be drawn.

As for the tens of millions of copies shipped to partners, that comes as no surprise. PC makers are banking on the novelty of Windows 8 to sell dozens of new, touch-enabled PCs and tablets, and in order to ship with Windows 8, manufacturers like Lenovo and Acer will have ordered licenses by the million?? although they will likely offer Windows 7 for some time to come as a budget option.

There are no firm take-aways from Ballmer's numbers, which were likely shared in order to whet the appetite of shareholders, developers and reporters, all eager to know the results of Microsoft's risky experiment in redesigning Windows. The next few weeks should bring more intelligible numbers and the opportunity to compare them, apples?to?apples, with Windows 7's sales.

India leaves interest rate unchanged

MUMBAI, India (AP) ? India's central bank left its key interest rate unchanged Tuesday but trimmed the cash reserve ratio, resisting growing pressure from New Delhi to cut rates even as it slashed its growth forecast and raised its inflation projection for Asia's third-largest economy.

Though the Reserve Bank of India left the policy rate at 8.0 percent because of inflation concerns, it did support the government's reform initiative by trimming the cash reserve ratio ? the percentage of deposits commercial banks must keep on hand ? by a quarter of a point, to 4.25 percent, effective November 3. It said this will inject 175 billion rupees ($3.2 billion) into a cash-constrained banking system.

RBI again slashed its growth outlook for the year ending March, from 6.5 percent to 5.8 percent. Its initial projection was 7.3 percent. The bank said headline inflation will likely hit 7.5 percent in March, up from an earlier forecast of 7.0 percent ? and far above the bank's medium term target of 3.0 percent.

RBI has been under growing pressure from New Delhi and business leaders to cut interest rates as growth slipped to its lowest levels since 2009, but the bank says inflation remains its "primary focus."

"Managing inflation and inflation expectations must remain the primary focus of monetary policy," the bank said in its quarterly policy statement Tuesday. The bank said that containing inflation will contribute to consumer and investor confidence, both key to sustaining growth in the medium term.

It said there is a "reasonable likelihood of further policy easing" in the January to March quarter, provided inflation eases as expected and New Delhi's ambitious reform agenda gets translated into action.

After peaking at 9.2 percent in the March 2011 quarter, India's economic growth slid to 5.3 percent a year later, its lowest level since the Great Recession in 2009. Though growth then ticked marginally higher, to 5.5 percent, RBI said the economy is still mired by stalled investment, weakening consumption and falling exports.

India's finance minister, Palaniappan Chidambaram, on Monday announced an ambitious fiscal consolidation plan, which was widely seen as prompt by New Delhi for a rate cut.

Chidambaram said India's fiscal deficit would be 5.3 percent for the year ending March, up from a budgeted 5.1 percent, before falling to 3.0 percent by fiscal 2017. He said the current account deficit would narrow to 3.7 percent of GDP, or $70.3 billion in the year ending March, from 4.2 percent of GDP ($78 billion) the prior year. The government, he added, is confident that the current account deficit will be fully financed through capital inflows. He said all flagship programs to protect the poor by guaranteeing them, for example, jobs and food ? which critics say are too costly ? will remain untouched.

The speech was part of New Delhi's campaign blitz to restore investor confidence and avoid a ratings downgrade. The government has also recently taken the politically difficult steps of hiking administered diesel prices and loosening some foreign investment restrictions. The moves helped boost the rupee and cheered equity markets.

Chidambaram's fiscal plan, however, came in for criticism as vague and unrealistic, and RBI's Tuesday statement cast into further doubt some of the finance ministry's assumptions.

"They laid down a roadmap but the measures announced so far will not be enough to meet the 5.3 percent deficit," Sonal Varma, economist at Nomura Financial Advisory and Securities in Mumbai, said Tuesday. "The current inflation and current account situation does not give the RBI the space to boost demand at this juncture."

RBI said that from April through August, the fiscal deficit was nearly two-thirds of the entire year's budget and cautioned that it is "expected to be higher than budgeted." The bank also noted the risk of volatile capital flows, and said that given global economic uncertainties financing a large current account deficit "poses challenges."

The bank said the current account and fiscal deficits "continue to pose significant risks to both growth and macroeconomic stability."

The bank praised the government's slew of recent policy announcements for having "positively impacted sentiment," but cautioned that they "need to be translated into effective action to convert sentiment into concrete investment decisions."

Chidambaram greeted the bank's policy decisions with disappointment, telling reporters Tuesday, "To face the challenge of growth, we walk alone."

Even in these polarized times, there are some things politicians of both parties can agree. Price gouging, for example, is wrong. New York Attorney General Eric Scheiderman, a Democrat, wants you to know it. But this isn?t just for soft-hearted liberals. New Jersey?s notoriously tough conservative governor, Chris Christie, also put out a weekend press release warning that ?price gouging during a state of emergency is illegal? and that complaints would be investigated by the attorney general. Specifically, Garden State merchants are barred from raising prices more than 10 percent over their normal level during emergency conditions (New York?s anti-gouging law sets a less precise definition, barring ?unconscionably extreme? increases).

The bipartisan indignation is heartening, but there?s one problem. These laws are hideously misguided. Stopping price hikes during disasters may sound like a way to help people, but all it does is exacerbate shortages and complicate preparedness.

The basic imperative to allocate goods efficiently doesn?t vanish in a storm or other crisis. If anything, it becomes more important. And price controls in an emergency have the same results as they do any other time:? They lead to shortages and overconsumption. Letting merchants raise prices if they think customers will be willing to pay more isn?t a concession to greed. Rather, it creates much-needed incentives for people to think harder about what they really need and appropriately rewards vendors who manage their inventories well.

Consider the case of poor Thakur Gas of Branchville, N.J., which was hit with a $50,000 fine in late September for price gouging charges arising out of Tropical Storm Irene. Christie specifically cited the case over the weekend as a cautionary tale of what awaits New Jersey retailers who try to adjust prices to shifting supply and demand conditions. Thakur?s crime, according to court papers, was raising the prices 17 percent when the storm hit, causing the store?s gross margins to spike.

This seems like a straightforward violation of New Jersey law, but what Thakur did also make perfect business sense. If there?s elevated demand for your product, you try to sell more of it. But if you can?t sell more volume because supplies have been disrupted by a storm, you raise prices. Customers aren?t going to like it (and the need to maintain good will with your customers should be a factor in any business?s decision-making) but they?re also not going to like it if you run out of gasoline by 2 p.m. because it has all been bought up by earlier, stockpiling drivers.

What Branchville, N.J., drivers ought to fear isn?t a few days of high gasoline prices, it?s the risk that station owners might not bother to open the station at all. For customers to suffer from a gasoline shortage even while gasoline sat idle in the storage tanks of local businesses would be absurd. If higher operating margins are what it takes to tempt people to brave difficult driving conditions for the sake of opening the store on a day when customers are likely to be scarce, that?s a small price to pay.

Indeed, many of the problems associated with weather emergencies are precisely caused by the fact that we can?t count on shops to ?gouge? their customers. I live in a neighborhood with buried power lines in a building that contains a supermarket on the ground floor. But I nonetheless found myself stuck in line Sunday evening at the Safeway stockpiling emergency supplies just in case something went badly wrong and knocked power out throughout the city. The issue wasn?t that I wouldn?t be able to get to the store in a worst-case scenario, as that I was afraid other people would already have bought up all the stuff. And indeed, by the time I made it, the shelves had been largely denuded of essentials such as bottled water, canned soup, batteries, and Diet Coke. Greater flexibility to raise prices would not only tend to curb overconsumption directly by encouraging people to buy less, it would inspire confidence that shortages wouldn?t arise, reducing the tendency toward panicky preemptive hoarding.

Last but by no means least, more price gouging would greatly improve inventory management. There is a large class of goods?flashlights, snow shovels, sand bags?for which demand is highly irregular. Maintaining large inventories of these items is, on most days, a costly misuse of storage space. If retailers can earn windfall profits when demand for them spikes, that creates a situation in which it makes financial sense to keep them on hand. Trying to curtail price gouging does the reverse.

None of which is to say that people should be greedy all the time. Disasters really are times when people pull together and we see large and small acts of kindness that rightly inspire us. But consider that declining to raise prices in the face of spiking demand and inelastic supply is a very odd form of charity: It doesn?t create any new resources, just allocates them arbitrarily to whoever shows up first. If you feel bad about the idea of earning windfall profits off the misfortunes of others, then donate the money to charity. If that seems too impersonal, give your employees a bonus for showing up under difficult circumstances. But storm or no storm, the best practice is to try to set prices that balance supply with demand. State governments shouldn?t be trying to stop you.

(AP) ? A decade since George Lucas said "Star Wars" was finished on the big screen, a new trilogy under new ownership is destined for theaters after The Walt Disney Co. announced Tuesday that it was buying Lucasfilm Ltd. from him for $4.05 billion.

The seventh movie, with a working title of "Episode 7," is set for release in 2015. Episodes 8 and 9 will follow. The trilogy will continue the story of Luke Skywalker, Han Solo and Princess Leia beyond "Return of the Jedi," the third film released and the sixth in the saga. After that, Disney plans a new "Star Wars" movie every two or three years. Lucas will serve as creative consultant in the new movies.

"I'm doing this so that the films will have a longer life," Lucas, the 68-year-old creator of the series and sole owner of Lucasfilm, said in an interview posted on YouTube. "I get to be a fan now ... I sort of look forward to it. It's a lot more fun actually, than actually having to go out into the mud and snow."

Disney CEO Bob Iger said Lucasfilm had already developed an extensive story line on the next trilogy, and Episode 7 was now in early-stage development. He said he talked with Lucas about buying the company from him a year and a half ago, but they didn't decide on a deal until very recently as Lucas set in motion his retirement.

"The last 'Star Wars' movie release was 2005's 'Revenge of the Sith' ? and we believe there's substantial pent-up demand," Iger said.

The blockbuster deal announced Tuesday will see Disney pay half the acquisition price in cash and half in newly issued stock. The company expects it to add to earnings in 2015. Along with the cash, Lucas will end up owning about 40 million Disney shares, which is about a 2.2 percent stake of the 1.83 billion shares that will be in circulation when the transaction closes.

The deal includes Lucasfilm's prized high-tech production companies, Industrial Light & Magic and Skywalker Sound, as well as rights to the "Indiana Jones" franchise.

Lucas was hailed as a cinematic visionary when the original "Star Wars" came out in 1977. But he had become an object of often-vicious ridicule by the time he released 3-D versions of all six films in the Star Wars franchise earlier this year.

Die-hard Star War fans had been vilifying Lucas for years, convinced that he had become a commercial sell-out and had compounded his sins by desecrating the heroic tale that he originally sought to tell.

They railed against him for adding grating characters such as Jar Jar Binks in the second trilogy and attacked him for tinkering with the original trilogy, too. Any revision in special edition or home video releases ? such as making the Ewoks blink or having a green-skinned alien named Greedo take the first shot at Han Solo in a famous bar scene ? were treated as blasphemy.

The criticism grated on Lucas, who vowed never to make another Star Wars movie.

"Why would I make any more when everybody yells at you all the time and says what a terrible person you are?" Lucas told The New York Times earlier this year.

"Indiana Jones and the Kingdom of the Crystal Skull," the fourth film in another lucrative franchise, subjected Lucas to even more barbs when it came to the big screen in 2008. Fans of those films were especially outraged about an opening scene that featured Indiana Jones crawling into a lead-lined refrigerator to survive a nuclear bomb blasting.

Lucas was fed up by the time he released "Red Tails," a movie depicting the valor of African-American pilots during World War II, earlier this year. He told the Times he was ready to retire from the business of making blockbusters and return to his roots as a student at USC's film school, where he once made a movie about clouds moving in a desert.

Kathleen Kennedy, the current co-chairman of Lucasfilm, will become the division's president and report to Walt Disney Studios Chairman Alan Horn. She will serve as executive producer for the new movies. Directors for the new movies have not yet been announced.

In the YouTube video, Lucas said the decision to continue with the saga wasn't inconsistent with past statements.

"I always said I wasn't going to do any more and that's true, because I'm not going to do any more, but that doesn't mean I'm unwilling to turn it over to Kathy to do more," Lucas said.

He said he has given Kennedy his story lines and other ideas, "and I have complete confidence that she's going to take them and make great movies."

Kennedy added that she and Lucas had discussed ideas with a couple of writers about the future movies and said Lucas would continue to have a key advisory role. "My Yoda has to be there," she said.

The deal brings Lucasfilm under the Disney banner with other brands including Pixar, Marvel, ESPN and ABC, all companies that Disney has acquired over the years.

A former weatherman who rose through the ranks of ABC, Iger has orchestrated some of the company's biggest acquisitions, including the $7.4 billion purchase of animated movie studio Pixar in 2006 and the $4.2 billion acquisition of comic book giant Marvel in 2009.

Coincidentally, Lucas owned the startup that later became Pixar, before he sold it to Apple's Steve Jobs in 1986 for about $5 million. When Jobs sold Pixar to Disney, he became Disney's largest single shareholder with a 7.7 percent stake. Those shares are now held in a trust.

Disney shares were not trading with stock markets closed due to the impact of Superstorm Sandy in New York. They closed on Friday at $50.08.

California Convent Becomes Retirement Home

A new retirement community is under construction in California. That?s not news in itself; after all, seniors and Baby Boomers are the fastest-growing age groups across North America.

But what makes the new retirement community, Mercy Auburn Senior Community,? newsworthy, is that it was originally designed as a convent for nuns. Today, with the aging of the Catholic order?s members, the convent is becoming a retirement home.

As reported in the Sacramento Bee newspaper, the retirement complex in Auburn, located northeast of the state capital of Sacramento, is expected to be home to 60 older women.

The convent was founded in the mid-1800s, and was built with the expectation that it would house generations of nuns, but the falling numbers of nuns, coupled with their increasing average age, has created an inevitable situation where the convent was better fit as a retirement community.

?Years ago, there were not options for women other than motherhood or religious life,? Janice Bader of the National Religious Retirement Office told the newspaper. ?Mothers were stay-at-home mothers. Women attracted to something of service outside the home didn?t have a lot of options.?

While that?s not great news for the Catholic order in Auburn, it?s good news for the area?s seniors, who now have a new California assisted living community.

Tsunami hits Hawaii after Canada earthquake

HONOLULU (Reuters) - Hawaii was hit by a tsunami on Saturday night prompting the authorities to order at least 100,000 people on the island state to move to higher ground.

The Pacific Tsunami Warning Center said the first tsunami wave was three feet high and less forceful than expected. Some forecasts had predicted a wave of up to six feet high.

"The tsunami arrived about when we expected it should," Senior Geophysicist Gerard Fryer told reporters at a news conference, saying: "I was expecting it to be a little bigger."

Other waves were expected.

The tsunami hit with little warning and an alert, issued at short notice due to initial confusion among scientists about the quake's undersea epicenter, caused massive traffic congestion as motorists made a mass exodus from low-lying areas.

The Warning Center had said the first tsunami wave would strike the islands at 10:28 p.m. Hawaii Standard Time.

Honolulu Mayor Peter Carlisle announced that all police and emergency personnel were being pulled out from potential flood zones shortly before the first wave, leaving anyone defying evacuation orders to fend for themselves. He urged motorists who remained caught in harm's way due to gridlocked roads to abandon their vehicles and proceed on foot.

"If you are stuck in traffic, you might consider getting out of your car and consider walking to higher ground. You will have to assess your own situation, depending on where you are right now. Right now it is critical," he said

Vindell Hsu, a geophysicist at the Tsunami Warning Center said an estimated 100,000 to 150,000 people who live in Hawaii's coastal zones had been urged to move to higher ground until after 10:30 p.m.

Governor Neil Abercrombie issued an emergency proclamation for the state.

The tsunami center cautioned that wave height could not be predicted and that the first wave "may not be the largest".

It said: "All shores are at risk no matter which direction they face".

CANADA QUAKE

The warnings followed a powerful earthquake with a magnitude of 7.7 that hit Canada's Pacific coastal province of British Columbia late on Saturday.

The U.S. Geological Survey said the quake was centered 123 miles south-southwest of Prince Rupert at a depth of 6.2 miles.

The Earthquakes Canada agency said the quake in the Haida Gwaii region was followed by numerous aftershocks as large as 4.6 and that a small tsunami has been recorded by a deep-ocean pressure sensor.

In Hawaii, tsunami warning sirens could be heard blaring out across Honolulu, the state capital on Oahu, the state's most populous island, prompting an immediate crush of traffic, with many motorists stopping first at service stations to top up with gasoline.

At movie theaters, films were halted in mid-screening as announcements were made urging patrons to return to their homes.

The last time Oahu had a tsunami warning was after the devastating Japanese earthquake of March 2011.

On Honolulu's famed Waikiki Beach, residents of high-rise buildings were told to move to the third floor or higher for safety.

Stephany Sofos, a resident of Diamond Head near Waikiki, said most people had either evacuated or relocated to a higher floor.

"I moved my car up the hill, packed up my computer and have my animals all packed and with me," Sofos said, saying that she had not yet seen any obvious receding of the surf, a telltale sign that a tsunami wave is imminent.

"I'm pretty confident because we have a lot of reefs out there and that will prevent any major damage. Maybe it's a false confidence, but I'm not really worried," she said, adding, "It is nerve-wracking."

Tsunami Warning Center Geophysicist Gerard Fryer said the tsunami had caught scientists by surprise.

"We thought that the earthquake was on land and when we learned that it was deeper undersea and we gathered more information, we had no choice but to issue a warning," he said

As residents scrambled to reach higher ground on Oahu, at least four major road accidents were reported by the state Emergency Medical Services. More accidents were also reported on the outer islands.

Obama and Romney: Where they stand on the issues

WASHINGTON (AP) ? A look at where Democratic President Barack Obama and Republican presidential rival Mitt Romney stand on a selection of issues:

ABORTION and BIRTH CONTROL:

Obama: Supports access to abortion. Health care law requires contraceptives to be available for free for women enrolled in workplace health plans, including access to morning-after pill, which does not terminate a pregnancy but is considered tantamount to an abortion pill by some religious conservatives. Supported requiring girls 16 and under to get a prescription for the morning-after pill, available without a prescription for older women.

Romney: Opposes access to abortion except in cases of rape, incest or risk to the woman's life. Previously supported access. Says state law should guide abortion rights, and Roe v. Wade should be reversed by a future Supreme Court ruling. But says Roe v. Wade is law of the land until that happens and should not be challenged by federal legislation seeking to overturn abortion rights affirmed by that court decision. "So I would live within the law, within the Constitution as I understand it, without creating a constitutional crisis. But I do believe Roe v. Wade should be reversed to allow states to make that decision." Said he would end federal aid to Planned Parenthood.

DEBT:

Obama: Failed in pledge to cut the deficit "we inherited" by half by the end of his first term. The deficit when he took office was $1.2 trillion, and the $800 billion stimulus bill Obama signed soon afterward increased the shortfall to more than $1.4 trillion. The deficit for the recently completed 2012 budget year registered at $1.2 trillion, marking the fourth consecutive year of trillion-dollar-plus red ink. Now promises to cut projected deficits by $4 trillion over 10 years, a goal that will require Congress to raise the capital gains tax, boost taxes on households earning more than $250,000 a year and impose a minimum 30 percent tax on incomes above $1 million. The target also assumes a reduction in the amount of interest the government must pay on its debt and incorporates $1 trillion in cuts already signed into law. Nation's debt surpassed $16 trillion this year. Federal spending is estimated at 23.5 percent of gross domestic product this year, up from about 20 percent in the previous administration, and is forecast to decline to 21.8 percent by 2016.

Romney: Promises to cut $500 billion per year from the federal budget by 2016 to bring spending below 20 percent of the U.S. economy and to balance it by 2020, but vital specifics are lacking. At the same time would increase military spending, reverse $716 billion in Medicare cuts and cut taxes. Defended 2008 bailout of financial institutions as a necessary step to avoid the system's collapse, opposed the bailout of General Motors and Chrysler. Stayed silent on the debt-ceiling deal during its negotiation, only announcing his opposition to the final agreement shortly before lawmakers voted on it. Instead, endorsed GOP "cut, cap and balance" bill that had no chance of enactment. Favors constitutional balanced budget amendment. Proposes 10 percent cut in federal workforce, elimination of $1.6 billion in Amtrak subsidies and cuts of $600 million in support for the arts and broadcasting.

ECONOMY:

Obama: Term marked by high unemployment, a deep recession that began in previous administration and officially ended within six months, and gradual recovery. Persistently high jobless rates of over 8 percent until the rate dropped to 7.8 in September, the same as it was in February 2009, Obama's first full month in office. The rate hit a high of 10 percent in October 2009. Businesses have added jobs for more than two years straight while public sector jobs have lagged. Obama responded to the recession with a roughly $800 billion stimulus plan that nonpartisan Congressional Budget Office estimated cut the unemployment rate by up to 1.8 percentage points. Continued implementation of Wall Street and auto industry bailouts begun under George W. Bush. Proposes tax breaks for U.S. manufacturers producing domestically or repatriating jobs from abroad and tax penalties for U.S. companies outsourcing jobs. Won approval of South Korea, Panama and Colombia free-trade pacts begun under previous administration, completing the biggest round of trade liberalization since the North American Free Trade Agreement and other pacts went into effect in the 1990s.

Romney: Favors lower taxes, less regulation, balanced budget, more trade deals to spur growth. Would replace jobless benefits with unemployment savings accounts. Proposes replacing certain provisions of the law toughening financial industry regulations after the meltdown in that sector. Proposes changing the law tightening accounting corporate regulations to ease requirements for mid-sized companies. "We don't want to tell the world that Republicans are against all regulation. No, regulation is necessary to make a free market work. But it has to be updated and modern."

EDUCATION:

Obama: Has approved waivers freeing states from the most onerous requirements of the Bush-era No Child Left Behind law with their agreement to improve how they prepare and evaluate students. "Race to the Top" grant competition has rewarded winning states with billions of dollars for pursuing education policies Obama supports. Won approval for a college tuition tax credit worth up to $10,000 over four years and more money for Pell Grants for low-income college students. Wants Congress to agree to reduce federal aid to colleges that go too far in raising tuition. Average tuition at four-year public colleges surged 26 percent in his term, by $1,800 to $8,655, as states cut aid, but federal grants and tax credits sheltered students from most of the increase, leaving them paying only $570 more.

Romney: Supported the federal accountability standards of No Child Left Behind law. In 2007, said he was wrong earlier in career when he wanted the Education Department shut because he came to see the value of the federal government in "holding down the interests of the teachers' unions" and putting kids and parents first. Has said the student testing, charter-school incentives and teacher evaluation standards of Obama's "Race to the Top" competition "make sense" although the federal government should have less control of education. Says increases in federal student aid encourage tuition to go up, too. Wants to see private lenders return to the federal student loan program.

ENERGY and ENVIRONMENT:

Obama: Ordered temporary moratorium on deep-water drilling after the massive BP oil spill in the Gulf of Mexico, but U.S. produced more oil in 2010 than it has since 2003 and all forms of energy production have increased under Obama. Approved drilling plan in Arctic Ocean opposed by environmentalists. Proposes Congress give oil market regulators more power to control price manipulation by speculators and stiffer fines for doing so. Sets goal of cutting oil imports by half by 2020.

Achieved historic increases in fuel economy standards for automobiles that will save money at the pump while raising the cost of new vehicles. Achieved first-ever regulations on heat-trapping gases blamed for global warming and on toxic mercury pollution from power plants. The rules on mercury could force dozens of older coal-fired plants to shut or spend billions to upgrade. Spent heavily on green energy and has embraced nuclear power as a clean source.

Failed to persuade a Democratic Congress to pass limits he promised on carbon emissions. Shelved plan to toughen health standards on lung-damaging smog. Rejected Keystone XL oil pipeline from Canada but supports fast-track approval of a segment of it. Proposes ending subsidies to oil industry but has failed to persuade Congress to do so.

Romney: Pledges U.S. will become independent of energy sources outside of North America by 2020, through more aggressive exploitation of domestic oil, gas, coal and other resources and quick approval of the Keystone XL pipeline. Supports opening the Atlantic and Pacific outer continental shelves to drilling, as well as Western lands, the Arctic National Wildlife Refuge and offshore Alaska. He also has proposed reducing obstacles to coal, natural gas and nuclear energy development. Proposes accelerating drilling permits in areas where exploration has already been approved for developers with good safety records.

Says green power has yet to become viable and the causes of climate change are unknown. Proposes to remove carbon dioxide from list of pollutants controlled by Clean Air Act and amend clean water and air laws to ensure the cost of complying with regulations is balanced against environmental benefit. Says cap and trade would "rocket energy prices."

FOREIGN POLICY:

Obama: Opposes a near-term military strike on Iran, either by the U.S. or by Israel, to sabotage nuclear facilities that could be misused to produce a nuclear weapon. Says the U.S. will never tolerate a nuclear-armed Iran but negotiation and pressure through sanctions are the right way to prevent that outcome. Reserves the right to one day conclude that only a military strike can stop Iran from getting the bomb. Declined to repeat the Libya air power commitment for Syrian opposition, instead seeks to build international consensus toward the goal of persuading President Bashar Assad to leave and to press Russia and China to stop shielding his government from international sanctions. Chastised Israel for continuing to build housing settlements in disputed areas and has pressed both sides to begin a new round of peace talks based on the land borders established after the 1967 Arab-Israeli conflict. Signed law to expand military and civilian cooperation with Israel. The law affirms U.S. support for negotiating the establishment of a Palestinian state, reflecting a U.S. bipartisan consensus. Opposes citing China as a currency manipulator, which could lead to broad trade sanctions, instead pressing the matter through diplomacy and aggressively bringing unfair-trade cases against China to the World Trade Organization.

Romney: Appears to present a clearer U.S. military threat to Iran and has spoken in more permissive terms about Israel's right to act against Iran's nuclear facilities without explicitly approving of such a step and while describing a U.S. attack against Iran as a last resort. "Of course you take military action" if sanctions and internal opposition fail to dissuade Tehran from making a nuclear weapon, he has said. Would identify those in Syrian opposition who share U.S. values, then work with U.S. allies to "ensure they obtain the arms they need to defeat" Syrian government. But has not proposed direct U.S. arms supplies to rebels and opposes U.S. military intervention for now. Associates himself more closely with hardline Israeli Prime Minister Benjamin Netanyahu, pledges more military assistance to Israel and agreed with Israel's position that Jerusalem is the capital, disregarding the Palestinians' claim to the eastern sector annexed by Israel in 1967 in a move that is not internationally recognized. Has branded Russia the "No. 1 geopolitical foe" of the U.S. and threatened to label China a currency manipulator in a move that could lead to broad trade sanctions and a trade war.

GAY RIGHTS:

Obama: Supports legal recognition of same-sex marriage, a matter decided by states. Opposed that recognition in 2008 presidential campaign ? and in 2004 Senate campaign ? while supporting the extension of legal rights and benefits to same-sex couples in civil unions. Achieved repeal of the military ban on openly gay service members. Has not achieved repeal of the Defense of Marriage Act, which denies federal recognition of same-sex marriages and affirms the right of states to refuse to recognize such marriages. Administration has ceased defending the law in court, but it remains on the books. Directed government to require all hospitals that get Medicare and Medicaid financing to grant visitation privileges to gay and lesbian partners of patients. But has declined to issue an executive order barring federal contractors from discriminating against gay employees, holding out instead for congressional action to extend such protection to workers in all sectors. In 1996 Illinois state Senate campaign, stated: "I favor legalizing same-sex marriages," a position he later abandoned at the federal level and now embraces again. "I've just concluded that for me personally it is important for me to go ahead and affirm that I think same-sex couples should be able to get married," he said.

Romney: Opposes legal recognition of same-sex marriage and says it should be banned with a constitutional amendment, not left to states. "Marriage is not an activity that goes on within the walls of a state." Also opposes civil unions "if they are identical to marriage other than by name," but says states should be left to decide what rights and benefits should be allowed under those unions. Says certain domestic partnership benefits ? largely unspecified ? as well as hospital visitation rights are appropriate but "others are not." Says he would not seek to restore the ban on openly gay military members. Asserted in 2002 campaign for Massachusetts governor that "all citizens deserve equal rights, regardless of sexual preference," in tune with statements years earlier as a Senate candidate that equality for gays and lesbians should be a "mainstream concern." But did not explicitly support marriage recognition and, as governor, opposed same-sex marriage when courts legalized it in Massachusetts. "My view is that marriage itself is between a man and a woman."

GUNS:

Obama: Has not pushed for gun control measures as president. Signed laws letting people carry concealed weapons in national parks and in checked bags on Amtrak trains. Favors "robust steps, within existing law" to address gun issues, White House says. Voices support for renewed ban on assault-type weapons but has not tried to get that done. Has not swung behind longshot Democratic bill, introduced after the Colorado movie theater shooting in July, to let only licensed dealers sell ammunition, require police to be notified after any sale of more than 1,000 rounds to an unlicensed person and require buyers who aren't licensed dealers to show a photo ID. Backed tougher gun control as Illinois and U.S. senator, including proposals to renew the assault-weapons ban and require background checks for buyers at gun shows.

Romney: Opposes stricter gun control laws. Suggested after the Colorado shooting that he favors tougher enforcement of existing gun laws, although the theater attack was carried out with legally obtained weapons. As Massachusetts governor, vowed in 2002 to protect the state's "tough gun laws," and in 2004 signed a Massachusetts ban on assault weapons. Quadrupled state's gun-licensing fee but loosened rules on the licenses and extended their duration. In 2008 primary campaign, said he would have signed the federal assault weapons ban if it had come to him as president, but he opposed any new gun legislation.

HEALTH CARE:

Obama: Achieved landmark overhaul putting U.S. on path to universal coverage now that Supreme Court has upheld the law's mandate for almost everyone to obtain insurance. Under the law, insurers will be banned from denying coverage to people with pre-existing illness, tax credits for middle-income people will subsidize premiums, people without work-based insurance will have access to new markets and small business gets help for offering insurance. Millions of low-income uninsured are to be reached through expansion of Medicaid with hefty subsidies to states, but Supreme Court limited federal power to penalize states that want to opt out of the expansion. Law's biggest changes start in 2014. "Nobody is going to go broke just because they get sick. And Americans will no longer be denied or dropped by their insurance companies just when they need care the most. That's what change is."

Health care law improves Medicare benefits, adding better coverage for seniors with high prescription costs as well as removing co-pays for a set of preventive benefits. It also cuts Medicare payments to hospitals and other providers by more than $700 billion over a decade. Those cuts are being used to provide health insurance to more working-age Americans, and the government also counts them as extending the life of the Medicare trust fund. Any future deficit-reduction deal, though, is likely to increase costs for middle-class and upper-income Medicare recipients, and Obama has indicated a willingness to consider increasing the eligibility from 65 to 67.

Romney: Promises to repeal Obama's health care law modeled largely after his universal health care achievement in Massachusetts because he says states, not Washington, should drive policy on the uninsured. Would expand individual tax-advantaged medical savings accounts and let the savings be used for insurance premiums as well as personal medical costs. Would let insurance be sold across state lines to expand options, and restrict malpractice awards to restrain health care costs. Says he would protect people with pre-existing conditions, though his plan only does so for those who maintain continuous coverage, not a major change from federal protections in effect before Obama's health care overhaul.

On Medicare, would introduce "generous" but undetermined subsidies to help future retirees buy private insurance or join a government plan modeled on traditional Medicare. Gradually increase the eligibility age to 67. Repealing Obama's health care law would roll back improved benefits for seniors unless Congress acts to protect them. It also would reverse Obama's Medicare cuts to hospitals and other providers. This would have the unintended consequence of hastening the insolvency of Medicare's trust fund. Would turn Medicaid program over to the states as a block grant.

IMMIGRATION:

Obama: Issued directive in June that immigrants brought illegally to the United States as children be exempted from deportation and granted work permits if they apply, a step that could benefit 800,000 to 1.4 million. "It's a temporary measure that lets us focus our resources wisely while offering some justice to these young people." Took the step after failing to deliver on a promised immigration overhaul, with the defeat of legislation that would have created a path to citizenship for young illegal immigrants enrolled in college or enlisted in the armed forces. Says he is still committed to it. Government has deported a record number of illegal immigrants under Obama, nearly 400,000 in each of the last three years.

Romney: Favors U.S.-Mexico border fence, opposes education benefits to illegal immigrants. Opposes offering legal status to illegal immigrants who attend college but would do so for those who serve in the armed forces. Would establish a national immigration-status verification system for employers and punish them if they hire noncitizens who do not prove their authorized status. The government's existing E-Verify system is voluntary. Proposes more visas for holders of advanced degrees in math, science and engineering who have U.S. job offers and would award permanent residency to foreign students who graduate from U.S. schools with a degree in those fields. Would end caps on visas for spouses and minor children of legal immigrants. Would honor work permits granted to illegal immigrants under Obama's policy of protecting those who came as children, but not accept new applicants. Promises to put a comprehensive immigration plan into place before those permits expire.

SOCIAL SECURITY:

Obama: Has not proposed a comprehensive plan to address Social Security's long-term financial problems. During budget negotiations in 2011, proposed adopting a new measurement of inflation that would reduce annual increases in Social Security benefits. The proposal would reduce the long-term financing shortfall by about 25 percent, according to the Social Security actuaries.

Romney: Protect the status quo for people 55 and over but, for the next generation of retirees, raise the retirement age for full benefits by one or two years and reduce inflation increases in benefits for wealthier recipients.

TAXES:

Obama: Wants to raise taxes on the wealthy and ensure they pay 30 percent of their income at minimum. Supports extending Bush-era tax cuts for everyone making under $200,000, or $250,000 for couples. But in 2010, agreed to a two-year extension of the lower rates for all. Wants to let the top two tax rates go back up 3 to 4 percentage points to 39.6 percent and 36 percent, and raise rates on capital gains and dividends for the wealthy. Health care law provides for tax on highest-value health insurance plans. Together with Congress, built a first-term record of significant tax cuts for families and business, some temporary.

Romney: Keep Bush-era tax cuts for all incomes and drop all tax rates further, by 20 percent, bringing the top rate, for example, down to 28 percent from 35 percent and the lowest rate to 8 percent instead of 10 percent. Curtail deductions, credits and exemptions for the wealthiest. End Alternative Minimum Tax for individuals, eliminate capital gains tax for families making below $200,000 and cut corporate tax to 25 percent from 35 percent. Does not specify which tax breaks or programs he would curtail to help cover costs.

TERRORISM:

Obama: Approved the raid that found and killed Osama bin Laden, set policy that U.S. would no longer use harsh interrogation techniques, a practice that had essentially ended late in George W. Bush's presidency. Largely carried forward Bush's key anti-terrorism policies, including detention of suspects at Guantanamo Bay despite promise to close the prison. Also has continued with military commissions instead of civilian courts for detainees and invocation of state secrets privilege in court. Expanded use of unmanned drone strikes against terrorist targets in Pakistan and Yemen. The deadly attack by militants on the U.S. Consulate in Benghazi, Libya, in September raised questions that persist about the quality of U.S. intelligence and about why requests for added security there were denied before the assault.

Romney: No constitutional rights for foreign terrorism suspects. In 2007, refused to rule out use of waterboarding to interrogate terrorist suspects. In 2011, his campaign said he does not consider waterboarding to be torture.

WAR:

Obama: Ended the Iraq war he had opposed and inherited, increased the U.S. troop presence in Afghanistan then began drawing down the force with a plan to have all out by the end of 2014. Approved use of U.S. air power in NATO-led campaign that helped Libyan opposition topple Moammar Gadhafi's government. Major reductions coming in the size of the Army and Marine Corps as part of agreement with congressional Republicans to cut $487 billion in military spending over a decade.

Romney: Proposes increase in military spending. Now fully endorses Obama's plan to end U.S. combat in Afghanistan in 2014. Would increase strength of armed forces, including number of troops and warships, adding almost $100 billion to the Pentagon budget in 2016. In addition, criticized congressional Republicans for negotiating a deficit-cutting deal with the White House that will mean automatic and massive cuts in Pentagon spending next year if federal budget deal is not reached in time.

In this series, I interview marketing professionals, models and actors with natural hair about their experiences in the industry as . For this installment, I?d like to introduce J?Zhanel ?JZ??Cole. Hailing from Los Angeles, California, J?Zhanel JZ Cole is a talented Actor, Model and Host.

After graduating from Columbia College Chicago with a degree in Arts, Entertainment & Media Management with a concentration in Music Business and a minor in Theater, she quickly began building a career working in artist management and development within the music industry, which afforded her the opportunity to travel and work with clients in both Los Angeles and Atlanta.

1. When and why did you decide to go natural?

To be honest, there was never a definitive time when I decided to ?go natural? as the texture of my hair has always been naturally curly ever since I was a little girl.??I recall people sharing a common affinity and admiration for my hair and the older girls in my school would want to comb my hair, style it and or just ask to play in my hair.??For this reason, my hair became this textured playground for all those who wanted to dive right in and explore its natural roots.?However, it wasn?t until my college years that I consciously began wearing my hair in its natural state more often.

2.???Describe your hair regimen. Do-it-yourself or let someone else do it for you??

I am a no holds barred ?Do It Yourself? type of girl.??So I usually tend to do my own hair on a daily basis, except for when I am preparing for an upcoming production, fashion show or while on set, in which I have my personal hair stylist tend to my crown.??I am very protective of my natural crown, so I don?t just let anyone just play in it as I did when I was a little girl.??My hair is like this sacred bounds and I am very careful who I let in the Curly Queendom!

3. What, if any, are the advantages to being natural in the industry? Have you ever experienced any challenges? Rude comments? Negative experiences??

I think the biggest advantage to being natural in the industry is versatility, which is one of the key components of an artist.??As a professional Actor and Model, it is very important for me to be able to portray many types of looks.??Since my hair is natural, I have the ability to give the casting directors a myriad of styles.??I can rock my hair in a curly crown, pin it up, adorn braids, ponytail, Mohawk and or bone straight.??This has been a significant part of the casting process for me and it has served as a greater advantage.??So far, in my career, I have never experienced any challenges and or received rude or negative comments as a result of me rocking my natural hair.??If anything, it always seems to become a conversation piece prior to my auditions.

4.?What do you think accounts for the representation of natural hair in the media? In your opinion, is it increasing, or has it always been there and we never noticed until we went natural (as some have suggested)??

I believe that it is increasing more as women are learning to accept and be comfortable in the skin that they are in and embrace their hair as a symbol of beauty as opposed to something that they should hide or cover up with weaves, wigs, hats or head wraps.???I think that it is something that we do subconsciously as African American women because we are often taught to hate the texture of our hair instead of adoring it. This self hate is a result of the whole ?good or bad? hair complex and I believe now, the tables have turned significantly because many women are learning that being natural is a beautiful thing!

?5.?What is your advice for aspiring models who want to wear their natural hair to auditions and casting calls??

I would just encourage ALL women to accept and love who they are from the inside and once that happens, that essence will transcend on the outside.??I would say be bold, be versatile, be beautiful, but most importantly; BE YOURSELF! In the end, agents, directors, casting directors, producers and everyone in between will appreciate it.

6. What upcoming projects do you have?

I am currently producing a docu-series entitled, ?I Am Arconic,? under my production company QueenDome Entertainment (QDE).??I Am Arconic? is a docu-series that highlights African American women within the industry who have made a mark in their respective fields (i.e. Photography, Acting, Modeling, Music, Make-Up, etc) as an artist and are quickly on their way to becoming an Icon, and or as I like to refer to them, ?Arconic!?? I am also working on some upcoming ventures for T.V. One as well as some upcoming national Ad Campaigns.

7. Is there anything else you?d like to add?

I would like to add that beauty comes in all kinds of shapes, colors and textures and as women we need to embrace that, starting from the top of our natural crowns and all the way down to our pedi-cured toes.??In my opinion confidence isn?t something that can be taught, however, it is something that one creates!??As women, we can create the difference within the media as well as across the board when it comes to presenting another dynamic of the standard of beauty. I believe that if there was an election for the next Natural Chic to represent this great nation of the United States of Natural America?then hands down, I would be the next Curl Queen of Staff! Lol

Messi among 23 candidates for world player award

ZURICH (AP) -Lionel Messi is in the running for a fourth consecutive FIFA world player of the year award after being selected Monday among the 23 candidates for the 2012 prize.

Messi and Barcelona teammates Sergio Busquets, Andres Iniesta, Gerard Pique and Xavi Hernandez are on the Ballon d'Or shortlist, while archrivals Real Madrid lead the way with six nominees, including last year's runner-up Cristiano Ronaldo.

Earlier on Monday, Messi was presented with his second Golden Boot award in recognition for scoring the most goals in Europe's domestic leagues last season.

A total of seven Spain internationals are in contention after the national team retained its European Championship title in July.

Manchester United striker Wayne Rooney is again the only England player on the list. United teammate Robin van Persie is also included after being the Premier League's leading scorer last season for Arsenal.

Italian players feature for the first time in three years as Manchester City striker Mario Balotelli and Juventus duo Andrea Pirlo and Gianluigi Buffon have been nominated.

Spain coach Vicente Del Bosque will be favored to win the world coach of the year award, while Roberto Di Matteo - who was only an assistant at the beginning of the year - is also on the 10-candidate list after leading Chelsea to the Champions League and FA Cup trophies.

No current Chelsea player was on the list, although former striker Didier Drogba was included.

Roberto Mancini has been included among the managers after steering Manchester City to the Premier League title. Cesare Prandelli, whose Italy team lost to Spain in the Euro 2012 final, is also in the running.

Long-serving Manchester United manager Alex Ferguson has been nominated despite failing to win a trophy last season. The 2011 winner Pep Guardiola - who left Barcelona at the end of last season - is also on the list.

The leading three candidates from each list will be announced Nov. 29 in Brazil, with the winners presented at a televised ceremony in Zurich on Jan. 7.

Voting is by national team coaches and captains, and journalists invited by joint organizer "France Football" magazine.
